1. Scope
This Policy applies to anyone who uses TEF TCF Canada Practice, whether or not they have an account, and to any content submitted, generated, transmitted, or accessed through the platform. We may enforce this Policy in our reasonable judgment, in addition to any other rights or remedies we have under our Terms of Service or applicable law.
2. Law and Decency
You agree not to:
- use the platform in a way that violates any applicable law, regulation, sanctions regime, or court order;
- use the platform to harass, threaten, defame, or abuse any person, including our staff in support communications;
- submit, transmit, or generate content that is unlawful, infringing, defamatory, fraudulent, sexually explicit, hateful, or that promotes violence or the sexual exploitation of minors;
- use the platform to violate any third party’s privacy, intellectual-property, or contractual rights;
3. Account Integrity
You agree not to:
- create more than one account for yourself, share account credentials, sell, rent, or transfer access to your account, or use another person’s account;
- create accounts using disposable email addresses, false identities, or for the purpose of evading bans, refunds, or free-tier limits;
- circumvent or attempt to circumvent paid-plan gates, free-tier limits, anonymous-trial limits, or rate limits;
- use the platform to obtain refunds you are not entitled to under our Refund Policy, or to abuse the referral program through self-referrals, fake referrals, or chargeback patterns;
4. Technical Integrity
You agree not to:
- interfere with the platform, probe vulnerabilities, introduce viruses or malware, or attempt unauthorized access to other users, accounts, systems, or data;
- use bots, headless browsers, scripted clients, or other automated tools to access the service in bulk, including for scraping, account creation, or load generation, except where we expressly allow it in writing;
- remove, alter, or obscure copyright, trademark, or other notices on the platform or in exported reports;
- reverse-engineer, decompile, or attempt to extract source code from the platform, except where applicable law expressly permits;
5. Intellectual Property and Content
You agree not to:
- copy, scrape, systematically extract, redistribute, mirror, sell, or publicly post our question bank, audio recordings, sample answers, AI feedback, score reports, or other site content without our express written permission;
- use the AI feedback features to evaluate or train any product or model that competes with us;
- submit work that is not your own to AI feedback features, or submit work on behalf of someone else taking an actual TEF or TCF examination;
- use the platform, exports, or AI outputs to misrepresent your actual French-language proficiency to any examination body, immigration authority, employer, educational institution, or other third party;
6. AI Features
The writing- and speaking-feedback features rely on third-party AI providers and on our own grading rubrics. You agree not to:
- submit highly sensitive personal information, government identifiers, payment-card numbers, or third-party confidential information through the writing or speaking features;
- use the speaking features to record, transcribe, or analyze conversations involving people who have not consented to being recorded;
- inject prompts, jailbreaks, or instructions intended to bypass our content rules, our system prompts, or the safety controls of any third-party AI provider we use;
- use the platform to generate content that you then submit as original human work to any examination, certification, employment, or academic process where doing so violates the rules of that process.
7. Reporting Abuse
If you believe someone is violating this Policy, contact us at support@tcftefprep.com with as much detail as you can provide, including any evidence (URLs, screenshots, or account identifiers). We will not disclose your identity to the reported party without your consent unless we are required to do so by law.
For copyright and similar intellectual-property complaints, please use the process described in our DMCA / Notice-and-Takedown policy.
8. Enforcement
We may, at our reasonable discretion and depending on the severity and pattern of the conduct, take any combination of the following actions in response to a breach of this Policy or the Terms of Service:
- a written warning, with or without a temporary suspension of access;
- permanent termination of your account, with or without forfeiture of unused AI credits, store credit, referral balances, and access to study history;
- denial of refund requests under our Refund Policy and clawback of referral payouts;
- reporting to the operator of any payment, email, or hosting service implicated in the abuse;
- civil action, including for liquidated damages of CAD $5,000 per question, audio file, or feedback record copied, scraped, redistributed, or posted in violation of these rules;
- referral to law enforcement and disclosure to authorities where required by law.
We do not guarantee any particular order or timing of these actions. Severe or repeated breaches may result in immediate termination without prior warning.
9. Cooperation with Authorities
We may cooperate with law-enforcement, regulatory, or examination authorities to investigate suspected misuse of the platform, including by preserving and disclosing relevant account, content, and log data where lawfully required or where we reasonably believe disclosure is necessary to protect the rights, property, or safety of users, the public, or tcftefprep.
10. Changes to This Policy
We may update this Policy from time to time. When we do, we will post the updated version on this page and revise the "Last Updated" date and version. Material changes will also be communicated through in-product messaging or email.
